By accessing or using the Rome Vatican Tours website at romevaticantours.com (the “Site”), operated by Attractions4Us LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you (the “Customer”) and Attractions4Us LLC.

These Terms are governed by Regulation (EU) 2016/679 (GDPR), the Italian Consumer Code (D.Lgs. 206/2005), Directive 2011/83/EU (Consumer Rights Directive), and applicable Italian and European Union legislation. If you do not agree to these Terms, please do not use our Site or services.

Rome Vatican Tours provides an online platform for browsing, selecting, and booking guided tours, experiences, transfers, and related travel services in Rome, Vatican City, and throughout Italy. We act as an intermediary between you and third-party tour operators and service providers (the “Operators”).

The contract for the delivery of each tour or experience is formed directly between you and the relevant Operator. We facilitate this transaction on behalf of the Operator in accordance with EU Directive 2015/2302 (Package Travel Directive) where applicable.

In accordance with Italian Consumer Code Art. 49–51 and the Consumer Rights Directive:

• Submitting a booking request constitutes an offer. The contract is formed when you receive a booking confirmation email.
• Prior to booking, you will be provided with the total price (including all taxes and fees), the main characteristics of the service, the identity of the Operator, and applicable cancellation terms.
• You must provide accurate and complete information when making a booking, including participant names, contact details, and any special requirements.
• Booking confirmations are sent to the email address provided at checkout. It is your responsibility to verify all booking details upon receipt.
• Certain tours may have minimum or maximum participant requirements. If minimums are not met, the Operator may reschedule or offer a full refund.

You will receive a durable copy of the contract terms and booking confirmation by email, as required by Art. 51 of the Italian Consumer Code.

All prices displayed on our Site are in US Dollars (USD) unless otherwise stated and include applicable taxes. In accordance with EU consumer protection rules, the total price (including all mandatory fees) is displayed before you finalise your booking.

• Payment is required in full at the time of booking unless otherwise specified.
• We accept major credit and debit cards. All payments are processed securely through PCI-DSS Level 1 certified payment providers.
• No hidden surcharges will be applied. If your bank charges currency conversion or international transaction fees, those are levied by your bank and are outside our control.
• We reserve the right to correct obvious pricing errors prior to booking confirmation. If a price error is identified after confirmation, we will contact you to offer the correct price or a full refund.

Under Italian Consumer Code Art. 52–59 (implementing EU Directive 2011/83/EU), consumers ordinarily have a 14-day right to withdraw from distance contracts without giving any reason.

However, pursuant to Art. 59(1)(n) of the Italian Consumer Code, the right of withdrawal does not apply to contracts for the provision of accommodation, transport of goods, car rental, catering, or services related to leisure activities where the contract provides for a specific date or period of performance. As our services consist of tours, experiences, and leisure activities provided on specific dates, this exemption applies to bookings made through our Site.

By completing your booking, you acknowledge that the right of withdrawal does not apply and that the applicable cancellation policy (see Section 7) governs any cancellations.

Cancellation policies vary by tour and Operator. The specific cancellation terms for each product are clearly displayed on the tour detail page and during the booking process before you complete payment. General guidelines:

• Free cancellation: Most tours offer free cancellation up to 24–72 hours before the scheduled start time. The exact deadline is displayed on the product page.
• Late cancellations: Cancellations made after the free cancellation window may be subject to partial or full charges, as stated in the product terms.
• No-shows: Failure to appear at the designated meeting point at the scheduled time constitutes a no-show and is not eligible for a refund unless the Operator’s specific policy states otherwise.
• Operator cancellations: If an Operator cancels due to weather, safety, insufficient participants, or operational reasons, you will receive a full refund or the option to reschedule at no additional cost.

Refunds are processed to the original payment method within 14 days of the cancellation approval, in compliance with EU payment services regulations. For cancellation requests, contact us at reservations@romevaticantours.com.

• You are responsible for arriving at the designated meeting point on time with any required documents (e.g., valid ID, printed or digital voucher).
• Certain tours may have age restrictions, physical fitness requirements, or dress codes (e.g., covered shoulders and knees for Vatican visits). These requirements are clearly noted on the tour detail page prior to booking.
• Operators reserve the right to refuse participation to anyone who appears intoxicated, behaves disruptively, or does not meet stated requirements. In such cases, no refund will be provided.
• You participate in all tours and activities at your own risk. We strongly recommend purchasing comprehensive travel insurance that covers cancellations, medical emergencies, and personal liability.

Rome Vatican Tours and Attractions4Us LLC act as an intermediary and are not the direct provider of tours and experiences. In accordance with applicable law, including the Italian Consumer Code:

• We are not liable for the acts, omissions, or negligence of Operators, their employees, or subcontractors.
• We are not responsible for personal injury, property damage, delays, cancellations, or any other loss arising from your participation in tours booked through our Site, except to the extent caused by our own negligence or wilful misconduct.
• Our total aggregate liability for any claim arising from use of our services shall not exceed the amount you paid for the specific booking in question.
• We are not liable for any indirect, incidental, consequential, or punitive damages.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable EU or Italian law. Statutory consumer rights under the Italian Consumer Code and EU consumer protection legislation are not affected.

All content on our Site, including text, images, graphics, logos, designs, and software, is the property of Attractions4Us LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.

By using our Site, you agree not to:

• Use the Site for any unlawful purpose
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorised access to our systems or infrastructure
• Interfere with the proper functioning of the Site
• Scrape, mine, or automatically extract data from the Site without written permission
• Use automated systems to access the Site in a manner that exceeds reasonable use

To the extent permitted by applicable law, you agree to indemnify and hold harmless Rome Vatican Tours, Attractions4Us LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our Site, violation of these Terms, or infringement of any third-party rights.

This indemnification clause does not affect any mandatory consumer rights you may have under EU or Italian law that cannot be waived by contract.

These Terms are governed by and construed in accordance with the laws of the Italian Republic and applicable European Union legislation.

For consumers residing in the EU/EEA, any disputes shall be subject to the jurisdiction of the courts in the consumer’s place of residence, in accordance with Regulation (EU) No 1215/2012 (Brussels I Recast). Italian consumers may bring proceedings before the competent Italian court of their place of residence or domicile.

For non-EU consumers, disputes shall be resolved in the courts of the State of New York, United States, unless mandatory local consumer protection laws provide otherwise.

In accordance with Regulation (EU) No 524/2013 and D.Lgs. 130/2015, EU consumers may use the European Commission’s Online Dispute Resolution (ODR) platform to resolve disputes arising from online purchases:

Our Site may contain links to third-party websites and services. We are not responsible for the content, privacy practices, or terms of any third-party sites. Accessing linked sites is at your own risk and subject to the terms and conditions of those sites.

Neither we nor the Operators shall be held liable for failure or delay in performing obligations due to circumstances beyond reasonable control, including but not limited to: natural disasters, epidemics, government restrictions, strikes, civil unrest, war, or disruptions to transportation or IT infrastructure. In such events, affected bookings will be rescheduled or refunded in full.

We reserve the right to update these Terms of Service at any time. Material changes will be communicated by posting the revised Terms on this page with an updated “Last updated” date. Changes do not apply retroactively to bookings already confirmed prior to the date of change. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while reflecting the original intent.
